
Frances Chen is a Managing Director in the Technology segment at FTI Consulting and is based in Shanghai. Ms. Chen advises multinational corporations (“MNCs”) and global law firms in developing strategies and formulating workflows for cross-border litigation, government and internal investigations, and data privacy matters. She routinely advises clients across a wide range of industries, including healthcare and life sciences, financial institutions, pharmaceutical and biotech companies, and technology and telecommunication companies.
As a licensed attorney, Ms. Chen combines her extensive industry experience and legal expertise to guide clients in navigating the complex legal and regulatory environments in China and beyond. She assists clients with designing and implementing data governance and compliance programs and manages multijurisdictional data privacy and cross-border data transfer in e-Discovery matters. Ms. Chen focuses on providing value-added consulting services that are both cost-effective and result-oriented. As a recognized expert, Ms. Chen is a frequent speaker on international conferences and compliance training for executives, including serving as a guest speaker for the M.B.A. program at IESE Business School on China’s business environment and government relations.
Ms. Chen has published numerous articles over the years, some selected publications include Key Questions Answered for China’s Personal Information Protection Law in Chief Privacy Officer (“CPO”) Magazine and Roadmap for cross-border data transfers: China’s new measures for security assessments in IFLR in 2022.
Ms. Chen received her J.D. from The University of Iowa College of Law and holds a B.A. in Administrative Science and a minor in Japanese from Colby College. She is a member of the New York State Bar. Ms. Chen speaks English, Mandarin, Foo-Chow, and Cantonese fluently.
Relevant Experience:
- Led a multidistrict litigation of a China e-Discovery matter for an international life science company; formulated data collection and processing strategies, devised document review workflow and provided support in other data-related challenges, including litigation hold measures and cross-border data transferring for this high-profile lawsuit
- Led a cybersecurity incident response project for a multinational semiconductor company in China; successfully assisted the client in navigating a high-stake incident response matter and undertaking on-the-ground remediation measures
- Led a data breach investigation for an e-commerce analytics company; devised action plans and coordinated penetration tests and cloud security assessment during the data breach and cybersecurity incident
- Led China data privacy project to ensure client’s compliance with China privacy and data security legislations, including the Personal Information Protection Law (“PIPL”), Cyber Security Law (“CSL”), and Data Security Law (“DSL”); conducted stakeholder interviews and identified processes and systems that require additional Personal Information Protection Impact Assessment (“PIPA”) review, delivered PIPL processing register and asset inventory, bilingual PIPL communications and awareness pack and reviewed organizational policy documentation
