SITUATION
A global media company faced 119 claims under the federal Video Privacy Protection Act. FTI Cybersecurity was engaged to perform a detailed forensic analysis of the company’s streaming services and data transmission practices and to serve as a technical expert witness.
OUR ROLE
FTI Cybersecurity conducted a comprehensive forensic analysis of streaming platforms accessed via mobile phones, laptops, smart TVs, streaming devices, and gaming consoles. Using a structured forensic workflow, we captured and analyzed data transmissions occurring through web and mobile applications, as well as on connected devices. The analysis evaluated whether personal information was transmitted, allowing the streamed video and the end user who requested it to be identified.
To enhance our analysis, we conducted stakeholder interviews, reviewed documentation, and assessed key system change logs to verify that current data transmissions aligned with historical practices. This thorough process was carried out across all divisions of the company.
OUR IMPACT
FTI Cybersecurity served as an expert witness and delivered three key reports to the client: an initial report, a rebuttal to the opposing expert’s report, and an amended final report. Our contributions played a crucial role in helping the client and their counsel achieve successful outcomes in all 119 cases, including the dismissal of some claims and the settlement of others on terms beneficial to the client.
