After four employees left an organization for a competing company, the company they joined developed a similar product, leading to allegations of intellectual property (IP) theft. FTI Cybersecurity was retained to opine on the organization’s security practices at the time of the employees’ departures to determine if they had reasonable measures in place to protect its IP.
Our team reviewed material provided by counsel and compared the organization’s cybersecurity controls to the NIST cybersecurity framework as a standard. With short notice from counsel, we drafted a quality rebuttal report to the opposition’s expert filing in just over 72 hours.
Our report magnified significant gaps that were omitted or not considered in the opposing experts’ reports, which cast doubt on the assertion that the organization had reasonable cybersecurity protections in place to protect its IP.
